Court Overturns Jury Decision in Ultimate Nutrition Case

SANTA ANA, Calif.In earlyJuly, the Superior Court of the State of California in Orange County vacated ajudgment against Ultimate Nutrition, in which an Orange County Superior Courtjury found the companys multivitamin was responsible for a competitiveswimmers failed drug test. The jury ruled the multi taken by Kicker Vencillwas contaminated with 19-norandrosterone, which allegedly led to Vencillsfailed drug test and subsequent suspension by the U.S. Anti-Doping Agency, andawarded damages of $578,635.

After the jury issued its decision, Ultimate Nutritionrequested the court vacate the judgment, arguing the jurys findings were notsupported by the evidence. In addition, prior to the original trial, UltimateNutrition hired an independent lab to test the allegedly contaminated lot ofproduct, which found no trace of contamination.After the Superior Court handeddown its decision, Vencill and Ultimate Nutrition reached a resolution to thecase out of court, according to Ultimate Nutritions legal counsel.
