Dannon to Pay Consumers $45 Million

PARISU.S. District Judge Dan Polster this week ordered Dannon to pay consumers up to $45 million in damages under the terms of a class-action settlement reached in federal court alleging misleading advertising about its Activia® and DanActive® yogurt products.

The agreement also calls for Dannon to change its health claims for Activia and DanActive, according to ABC News. The company stands by its advertising and denies any wrongdoing.; however, Dannon has settled to avoid the cost and distraction of litigation.

Consumers who purchased any DanActiv or Activia yogurt can visit www.dannonsettlement.com and submit a claim form for reimbursement. If consumers still have proof they purchased these items they may be entitled to up to $100. Consumers who do not have receipts or proof of purchase can submit claims for up to $30. All claims must be submitted by Oct. 1, 2010.
