DES MOINES, IowaKemin Foods, L.C. and OmniActive Health Technologies, Inc. and OmniActive Health Technologies, Ltd. reached an amicable settlement of their patent dispute. Terms of the settlement were not disclosed.
The parties agreed that Kemin's US Patent No. 5,382,714 ("the '714 patent") titled "Process for Isolation, Purification and Recrystallization of Lutein from Saponified Marigold Oleoresin and Uses Thereof" and the reissues of that patent are valid and enforceable. In conjunction with the settlement, OmniActive will promote and sell its newly launched Lutemax 2020 products.
