NEW YORK—Gary Null, Ph.D., filed a lawsuit in the Supreme Court of New York County in late April, alleging one of his contract manufacturers erred in preparing the vitamin D source for a batch of his product, Ultimate Power Meal, delivering 1,000 times more vitamin D than labeled. The civil lawsuit seeks damages of $10 million from Triarco Industries, alleging the Wayne, N.J.-based company did not adequately test the ingredient before sending it for further processing.
According to the New York Post, Null consumed several daily doses of the product in December 2009, and became ill with serious fatigue and bleeding “from within his feet.” He was diagnosed with extremely elevated levels of vitamin D, which he tracked back to the use of the product.
A statement from Null on his Web site, posted after the New York Post’s story, noted in part: “Last December it was brought to my attention that one our subcontractors made a mathematical error of adding too much Vitamin D to the Power Meal product. It was immediately removed from the market and we commenced with a thorough recall and warning campaign to all customers who purchased it. As a result, the relationship with the subcontractor was immediately severed. Fortunately, only one lot of Power Meal was defective.”
However, the New York Post also cited papers filed in the lawsuit reporting six consumers were hospitalized with severe kidney damage.
