BOSTON—The University of Massachusetts is suing Universal Sequence Inc. (USI), alleging the company is violating UMass trademarks through sales of a dietary supplement formulated to help Alzheimer’s patients, Mass High Tech reported. According to the story, the civil complaint, filed in U.S. District Court, District of Massachusetts, by Attorney General Martha Coakley, UMass and a private law firm, is seeking treble damages from USI (dba MemoryXL, MemXL.com and My MXL.com) and its owner, Richard F. Peisch, based on the company’s profits.
According to the complaint, UMass researchers developed a dietary supplement formula for protecting cognitive and brain function, and trademarked the name MemoryXL. UMass entered into a licensing agreement with Universal Sequence in early 2009 to use the MemoryXL trademark and sell the product commercially; however, Mass High Tech noted the suit claims the agreement was cancelled in late 2009, but USI continued to use the trademark and direct consumers to a new Web site to purchase the product.
