Supplement Companies Dismiss Patent Suit

SAN JOSE, Calif.—J.R. Carlson Laboratories, Metagenics Inc. and Nordic Naturals Inc. jointly released a statement June 9 announcing the companies agreed to dismiss a patent infringement suit, filed by Nordic Naturals in May 2007 in the U.S. District Court for the Northern District of California. Under terms of the stipulated dismissal, Watsonville, Calif.-based Nordic Naturals’ claims for patent infringement and unfair competition were dismissed with prejudice. The declaratory relief claims for non-infringement by Carlson Labs, Arlington Heights, Ill., and Metagenics, San Clemente, Calif., were dismissed with prejudice, and their affirmative defenses and declaratory relief claims for invalidity were dismissed without prejudice. Each party agreed to bear its own attorneys’ fees and costs.
