The Dietary Supplement Health & Education Act (DSHEA) established the category of dietary supplements, along with developing a paradigm for making structure/function statements and permitting the use of third-party literature to help guide consumers in making healthy choices. What DSHEA didn’t do was remove dietary supplements from regulatory oversight, or exempt these products from the basic requirement of substantiating the safety of their products.
Product claims—whether health claims, structure/function claims or nutrient content claims—carry a need for substantiation and are regulated by both FDA and FTC. Companies face challenges developing claims that effectively convey the benefits of products to consumers while still staying within legal boundaries.
