Judge Freezes Assets in Body Solutions Case

WASHINGTON--On Dec. 23, a federal judge entered stipulated orders for a preliminary injunction, as well as a freeze on assets, against Harry Siskind and Edward G. D'Alessandro Jr., the two individuals named in the Federal Trade Commission (FTC) suit against San Antonio, Texas-based Mark Nutritionals Inc. In that suit, the company denied all liability alleged by FTC, as well as denied having violated the law when using DJs nationwide to give testimony as to the effects of the company's Body Solutions Evening Formula. However, the company did stipulate to enter a preliminary injunction with FTC (www.ftc.gov).

The injunctions, which will be in effect until the court issues a final ruling, prohibit the defendants from making false or misleading representations about Evening Formula, or to use the term "weight-loss" in the name of its product until the defendants have competent and reliable scientific evidence that substantiates that claim.

The injunctions also freeze Siskind and D'Alessandro's assets, which may be used as potential refund monies to customers.
